  1. Tendo-se frustado a tentativa de concilia\u00e7\u00e3o em ac\u00e7\u00e3o de impugna\u00e7\u00e3o de despedimento promovida pelo trabalhador, a entidade patronal \u00e9 imediatamente notificada nos termos e para os efeitos do disposto no nº 4 do artº 98º-I do CPT (apresenta\u00e7\u00e3o do articulado motivador do despedimento e jun\u00e7\u00e3o do procedimento disciplinar…).<\/li>\n
  2. A entidade patronal para al\u00e9m de poder apresentar a motiva\u00e7\u00e3o do despedimento deve juntar tamb\u00e9m, entre outros, o processo disciplinar.<\/li>\n
  3. Se o n\u00e3o fizer a consequ\u00eancia para essa omiss\u00e3o \u00e9 a declara\u00e7\u00e3o da ilicitude do despedimento – nº 3 do artº 98º-J.<\/li>\n
  4. A notifica\u00e7\u00e3o do trabalhador para contestar apenas dever\u00e1 ser feita depois de se verificar se o disposto no nº 3 do artº 98º-J do CPT foi ou n\u00e3o cumprido, se h\u00e1 ou n\u00e3o que proferir decis\u00e3o a julgar o despedimento il\u00edcito.\n
