  1. A declara\u00e7\u00e3o do empregador ao trabalhador, comunicando a caducidade do contrato de trabalho por encerramento total e definitivo da empresa, bem como que lhe seria paga uma compensa\u00e7\u00e3o pela caducidade calculada nos termos previstos no C\u00f3digo do Trabalho, \u00e9 uma declara\u00e7\u00e3o negocial que se torna eficaz logo que chega ao conhecimento do trabalhador, passando a ser irrevog\u00e1vel.<\/li>\n
  2.  No caso em que o trabalhador apenas exige judicialmente o pagamento da referida compensa\u00e7\u00e3o, cumpre reconhecer-lhe o direito \u00e0 mesma, ainda que se n\u00e3o demonstrem os fundamentos da caducidade do contrato, pois eles n\u00e3o tinham, tamb\u00e9m no caso, que ser alegados e provados pelo trabalhador como facto constitutivo do seu direito ao montante daquela compensa\u00e7\u00e3o.
