  1. Atenta a natureza de uma pena ou san\u00e7\u00e3o, o condenado tem de senti-la sob pena de se poder traduzir em “absolvi\u00e7\u00e3o encapotada”, e n\u00e3o surtir o efeito pretendido pela lei;<\/li>\n
  2. As penas t\u00eam essa designa\u00e7\u00e3o, de outro modo n\u00e3o o seriam, nem constituiriam dissuasor necess\u00e1rio para prevenir as infra\u00e7\u00f5es, se n\u00e3o forem sentidas como tal, quer pelo agente, quer pela comunidade em geral.
