Para o preenchimento do tipo objectivo do crime de viola\u00e7\u00e3o de medida de interdi\u00e7\u00e3o de entrada e perman\u00eancia ilegal em territ\u00f3rio nacional \u00e9 que o agente seja cidad\u00e3o estrangeiro, que tenha entrado em territ\u00f3rio nacional e que o tenha feito durante per\u00edodo de tempo abrangido por interdi\u00e7\u00e3o.<\/li>\n
  2. N\u00e3o se tendo o Tribunal a quo pronunciado sobre o momento em que o arguido ter\u00e1 entrado em territ\u00f3rio nacional, manifesto \u00e9 que a decis\u00e3o recorrida padece de insufici\u00eancia da mat\u00e9ria de facto provada para a decis\u00e3o.
