  1. Em termos de dura\u00e7\u00e3o da liberdade condicional, fixa o n.º 5, do art.º 61º, do C. Penal, que esta tem uma dura\u00e7\u00e3o igual ao tempo de pris\u00e3o que falte cumprir, at\u00e9 ao m\u00e1ximo de cinco anos, considerando-se ent\u00e3o extinto o excedente da pena.<\/li>\n
  2. Esta extin\u00e7\u00e3o constitui uma modifica\u00e7\u00e3o substancial da condena\u00e7\u00e3o, pelo que tal norma deve ser interpretada no sentido de s\u00f3 permitir excepcionalmente a dita modifica\u00e7\u00e3o substancial da pena.
