    \tA senten\u00e7a que d\u00ea como verificada a ilegalidade dos actos tribut\u00e1rios (liquida\u00e7\u00f5es adicionais do IVA e IRC) e como n\u00e3o provada a exist\u00eancia de simula\u00e7\u00e3o constitui caso julgado para o processo penal tribut\u00e1rio relativamente a estas quest\u00f5es, nos termos dos artigos 51.\u00ba (RJIFNA) e 48.\u00ba (RGIT); \t<\/div>\n<\/li>\n

    \tSe a senten\u00e7a se limitou a julgar extinta a inst\u00e2ncia impugnat\u00f3ria, por inutilidade superveniente da lide, nos termos do artigo 287.\u00ba, al\u00ednea e) do CPC, ex vi do artigo 2.\u00ba, al\u00ednea e) do CPPT, por prescri\u00e7\u00e3o da obriga\u00e7\u00e3o tribut\u00e1ria \u2013 n\u00e3o tendo, por isso, conhecido do objecto da impugna\u00e7\u00e3o \u2013, em obedi\u00eancia ao princ\u00edpio da sufici\u00eancia do processo penal plasmado no artigo 7.\u00ba do CPP, as quest\u00f5es relevantes, maxime, as que se correlacionam com a simula\u00e7\u00e3o, devem ser decididas no dom\u00ednio do processo penal. \t<\/div>\n<\/li>\n<\/ol>\n
