    Da acusa\u00e7\u00e3o n\u00e3o consta, expressamente, nem tinha de constar face ao regime ent\u00e3o aplic\u00e1vel, que o arguido entregou o cheque na data nele aposta, mas igualmente n\u00e3o consta que o entregou em data anterior. Seja, podia ter sido entregue ao tomador na data que dele consta.<\/div>\n<\/li>\n

    Aceitando-se distinta conclus\u00e3o, pensamos ter o M.mo Juiz recorrido antecipado um ju\u00edzo inexor\u00e1vel, conceb\u00edvel apenas e s\u00f3 depois de averigua\u00e7\u00e3o efectiva sobre o facto que o pode eventualmente suportar.<\/div>\n<\/li>\n

    Os termos em que se mostra redigida a acusa\u00e7\u00e3o, se complementada com a queixa inicialmente apresentada, em contr\u00e1rio, faz, por ora, prevalecer o entendimento de que n\u00e3o estamos perante um cheque post datado, pois ao menos daquela resulta ter sido emitido e entregue no dia e com data de 8 de Junho de 1996 (isto sem olvidarmos o desvalor ou inocuidade que aquela poder\u00e1 at\u00e9 vir a assumir em audi\u00eancia).<\/div>\n<\/li>\n<\/ol>\n
