  1. \u00a0\tN\u00e3o tendo o arguido, depois de haver sido submetido a fiscaliza\u00e7\u00e3o para detec\u00e7\u00e3o de \u00e1lcool no sangue, mediante alcool\u00edmetro, requerido, como a lei lhe permite, a contraprova do exame efectuado n\u00e3o se revela leg\u00edtimo o afastamento do resultado obtido, e constante do tal\u00e3o que acompanha o auto de noticia, com a invoca\u00e7\u00e3o do princ\u00edpio in dubio pro reo<\/em>, por aus\u00eancia de d\u00favida razo\u00e1vel no esp\u00edrito do julgador. \t<\/li>\n
