  1. O tribunal s\u00f3 deve negar a aplica\u00e7\u00e3o de uma pena alternativa ou de substitui\u00e7\u00e3o quando a execu\u00e7\u00e3o da pris\u00e3o se revele, do ponto de vista da preven\u00e7\u00e3o especial de socializa\u00e7\u00e3o, necess\u00e1ria, ou em todo o caso, provavelmente mais conveniente do que aquelas penas<\/li>\n
  2. Chegando \u00e0 conclus\u00e3o que a pena de pris\u00e3o \u00e9 a adequada ao caso, e que o arguido nunca sentiu o efeito da reclus\u00e3o, mostrando-se proporcionado aplicar-lhe um regime de cumprimento mais flex\u00edvel, que lhe permita, nomeadamente, exercer uma atividade e retirar todas as consequ\u00eancias da anterior condena\u00e7\u00e3o de suspens\u00e3o condicionada da pris\u00e3o, pode a pena ser executada em regime de semideten\u00e7\u00e3o
