  1. O crime de venda, circula\u00e7\u00e3o ou oculta\u00e7\u00e3o de produtos ou artigos protege o interesse comercial da marca. O crime de fraude nas mercadorias protege o interesse do p\u00fablico em geral.<\/li>\n
  2. Mesmo sem ser industrial de fabrico de roupas o arguido atenta contra o interesse comercial da marca quando as vende, sabendo que a marca anunciada n\u00e3o corresponde \u00e0 realidade.<\/li>\n
  3. Existe uma rela\u00e7\u00e3o de concurso efectivo de crimes, quando a conduta do agente preenche o crime de fraude sobre mercadorias (p. e p. pelo art.º 23º do D. L.28\/84) e o crime de contrafac\u00e7\u00e3o de marcas (p. e p. pelo art.º 324º do C. P. Industrial –D. L. 36\/2003, de 5\/3).\n
