O prazo de 90 dias a que alude o artº 105º nº 4 do RGIT, n\u00e3o deve ser tido em conta para efeitos de contagem do prazo de prescri\u00e7\u00e3o do procedimento criminal, pois aquele constitui uma condi\u00e7\u00e3o objetiva de punibi­lidade que n\u00e3o impede o exerc\u00edcio da a\u00e7\u00e3o penal, apenas impedindo que possa ter lugar a puni\u00e7\u00e3o;<\/li>\n
  2. Tal prazo de prescri\u00e7\u00e3o inicia-se na data em que o crime se consumou, isto \u00e9 em que termina o prazo para o cumprimento dos respetivos deveres tribut\u00e1rios.
