  1. A subscri\u00e7\u00e3o de uma declara\u00e7\u00e3o jur\u00eddica unilateral por parte de um ex-c\u00f4njuge perante o outro tendente a estabelecer as condi\u00e7\u00f5es finais do acerto de contas\/“tornas” subsequente a partilhas feitas, desde que sejam a operar segundo a regra da metade imposta pelo art. 1730º do C.Civil para o caso, n\u00e3o configura um neg\u00f3cio il\u00edcito ou imposs\u00edvel, antes \u00e9 express\u00e3o do princ\u00edpio da liberdade contratual (cf. art. 405º do C.Civil).<\/li>\n
  2. E a pretens\u00e3o exercida em ju\u00edzo desse acerto final de contas\/“tornas”, enquanto concretiza\u00e7\u00e3o do poder\/dever de partilha entre os ex-c\u00f4njuges dos bens comuns, n\u00e3o configura o exerc\u00edcio de um direito pelo seu titular em termos de este exceder “manifestamente os limites impostos pela boa f\u00e9, pelos bons costumes ou pelo fim social ou econ\u00f3mico desse direito” (art. 334º do C.Civil).\n
