  1. O executado pode opor \u00e0 execu\u00e7\u00e3o, que tenha por t\u00edtulo um requerimento de injun\u00e7\u00e3o ao qual foi aposta a f\u00f3rmula execut\u00f3ria, os fundamentos plasmados no artigo 816º do CPC.<\/li>\n
  2. Por violar o princ\u00edpio de proibi\u00e7\u00e3o da indefesa, enquanto acep\u00e7\u00e3o ao direito e aos tribunais – artigo 20º da CRP – n\u00e3o se aplica o artigo 814º do CPC por se entender que \u00e9 inconstitucional quando interpretado no sentido de limitar a oposi\u00e7\u00e3o \u00e0 execu\u00e7\u00e3o fundada em injun\u00e7\u00e3o \u00e0 qual foi aposta a f\u00f3rmula execut\u00f3ria.\n
