Sum\u00e1rio:<\/strong><\/p>\n

  1.  A inst\u00e2ncia extingue-se sempre que se torne supervenientemente in\u00fatil, i.e., sempre que por facto ocorrido na pend\u00eancia da inst\u00e2ncia, a continua\u00e7\u00e3o da lide n\u00e3o tenha qualquer utilidade (artº 287 e) do CPC).<\/li>\n
  2. A inst\u00e2ncia extingue-se ou finda de forma anormal todas as vezes que, ou por motivo atinente ao sujeito, ou por motivo atinente ao objecto, ou por motivo atinente \u00e0 causa, a respectiva rela\u00e7\u00e3o jur\u00eddica substancial se torne in\u00fatil, i.e., deixe de interessar a sua aprecia\u00e7\u00e3o.<\/li>\n
  3.  N\u00e3o \u00e9 suficiente, portanto, a exist\u00eancia de um facto que torne a lide in\u00fatil; exige-se, para que se verifique a causa de extin\u00e7\u00e3o da inst\u00e2ncia considerada, que o facto seja superveniente.<\/li>\n
  4. Como a inst\u00e2ncia se considera iniciada com a proposi\u00e7\u00e3o da ac\u00e7\u00e3o e esta se considera proposta, intentada ou pendente logo que seja recebida pela secretaria a respectiva peti\u00e7\u00e3o inicial, segue-se que s\u00f3 o facto ocorrido posteriormente ao recebimento da peti\u00e7\u00e3o inicial se deve considerar superveniente (artºs 150 e 467 nº 1 do CPC).\n
