\u00e9 accion\u00e1vel independentemente da alega\u00e7\u00e3o e demonstra\u00e7\u00e3o da causa da sua subscri\u00e7\u00e3o pelos sujeitos cambi\u00e1rios, desde que apresentado a pagamento no prazo de oito dias a contar da data da sua emiss\u00e3o e que a recusa de pagamento se verifique dentro desse mesmo prazo.  \t<\/li>\n<li>Sem este requisito, o cheque perde a sua potencialidade cambi\u00e1ria, n\u00e3o valendo mais como t\u00edtulo de cr\u00e9dito, mas apenas como mero quir\u00f3grafo de uma obriga\u00e7\u00e3o.  \t<\/li>\n<li>Como documento particular, assinado pelo devedor, contendo em si o reconhecimento de uma obriga\u00e7\u00e3o pecuni\u00e1ria de montante determinado, por parte de quem o emite, o cheque \u00e9, por si s\u00f3, condi\u00e7\u00e3o
