  1. O disposto no artº 848º, nº 2 do CPC n\u00e3o habilita o executado a ilidir a presun\u00e7\u00e3o a\u00ed estabelecida antes de ser efectuada a penhora dos bens em causa.<\/li>\n
  2. A substitui\u00e7\u00e3o que o artº 834º, nº 3, al. a) do CPC prev\u00ea possa ser requerida pelo executado ao agente de execu\u00e7\u00e3o, al\u00e9m de estar condicionada \u00e0 n\u00e3o oposi\u00e7\u00e3o do exequente, reporta-se a bens j\u00e1 penhorados, n\u00e3o valendo para obstar \u00e0 penhora de determinados bens em detrimento de outros que o executado apresente e que igualmente assegurem os fins da execu\u00e7\u00e3o<\/li>\n
  3. Ao executado n\u00e3o \u00e9 l\u00edcito deduzir oposi\u00e7\u00e3o \u00e0 penhora com base na circunst\u00e2ncia de os bens penhorados pertencerem a terceiro, pois esse fundamento n\u00e3o se ajusta \u00e0queles que o artº 863º-A do CPC prev\u00ea poderem alicer\u00e7ar uma oposi\u00e7\u00e3o.\n
