  1. Nos acidentes de via\u00e7\u00e3o a que seja j\u00e1 aplic\u00e1vel o regime do Decreto-Lei nº 291\/2007, nomeadamente a al. c) do nº 1 do artº 27º, para ser reconhecido direito de regresso \u00e0 seguradora que satisfez a indemniza\u00e7\u00e3o, basta ter sido alegado e provado que o condutor\/segurado deu causa ao acidente e conduzia com uma taxa de alcoolemia superior \u00e0 permitida por lei, dispensando-se a alega\u00e7\u00e3o e prova de nexo de causalidade adequada entre a etiliza\u00e7\u00e3o e o acidente.<\/li>\n
  2. Face \u00e0 presun\u00e7\u00e3o estabelecida no artº 674º-A do CPC, n\u00e3o \u00e9 ao benefici\u00e1rio da dita presun\u00e7\u00e3o que incumbe fazer prova dos factos atinentes quesitados e j\u00e1 dados como assentes na senten\u00e7a penal transitada em julgado. \u00c9 ao n\u00e3o benefici\u00e1rio dessa presun\u00e7\u00e3o que compete ilidir essa presun\u00e7\u00e3o que o desfavorece.\n
