  1. A consequ\u00eancia pr\u00e1tica do caso julgado traduz-se em dar por esgotado um «thema decidendum».<\/li>\n
  2. No plano dos fundamentos de facto, preclude-se ao autor a possibilidade de, em nova ac\u00e7\u00e3o, e dentro da mesma causa de pedir, vir carrear outros fundamentos, de facto ou de direito, n\u00e3o produzidos no processo anterior.<\/li>\n
  3. Por insufici\u00eancia de mat\u00e9ria de facto, n\u00e3o pode vir a discutir-se na nova ac\u00e7\u00e3o a factualidade que deveria ter sido alegada naquela primeira ac\u00e7\u00e3o e que na realidade o n\u00e3o foi.<\/li>\n
  4. A preclus\u00e3o opera, portanto, relativamente a todos os factos que a parte podia ter deduzido na ac\u00e7\u00e3o anterior.<\/li>\n
