Em ac\u00e7\u00e3o instaurada contra a institui\u00e7\u00e3o de seguran\u00e7a social competente para atribui\u00e7\u00e3o das presta\u00e7\u00f5es por morte de benefici\u00e1rio dessa institui\u00e7\u00e3o, ao autor compete provar, para al\u00e9m da uni\u00e3o de facto, h\u00e1 mais de dois anos, com o referido benefici\u00e1rio (n\u00e3o casado, ou separado judicialmente de pessoas e bens), que carece de alimentos e que n\u00e3o lhe \u00e9 poss\u00edvel obter estes do seu c\u00f4njuge ou ex-c\u00f4njuge, dos seus descendentes, dos seus ascendentes e dos seus irm\u00e3os, nem da heran\u00e7a do de cujus.
