    \u00c9 extempor\u00e2nea a argui\u00e7\u00e3o da nulidade da insufici\u00eancia de grava\u00e7\u00e3o da prova com a apresenta\u00e7\u00e3o de alega\u00e7\u00f5es no \u00e2mbito do recurso interposto da senten\u00e7a final, sempre que a parte n\u00e3o demonstre o respeito pelo prazo resultante do regime geral.<\/div>\n<\/li>\n

    A responsabilidade objectiva ou pelo risco \u00e9 sempre daquele que “tiver a direc\u00e7\u00e3o efectiva de qualquer ve\u00edculo de circula\u00e7\u00e3o terrestre e o utilizar no seu pr\u00f3prio interesse…” (artigo 503.º, n.º 1 do C\u00f3digo Civil). Logo, condi\u00e7\u00e3o sine qua non da exist\u00eancia de responsabilidade pelo risco \u00e9 que o dano tenha sido provocado por um qualquer ve\u00edculo de circula\u00e7\u00e3o terrestre.<\/div>\n<\/li>\n

    N\u00e3o estando provado que o acidente foi causado por um determinado ve\u00edculo que, por n\u00e3o identificado, implicaria a responsabilidade do Fundo de Garantia Autom\u00f3vel, nem mesmo por qualquer outro ve\u00edculo que, por tamb\u00e9m n\u00e3o identificado, obrigasse a mesma entidade a responder pelo dano, n\u00e3o pode concluir-se que esta entidade sempre deveria responder pelo risco.<\/div>\n<\/li>\n<\/ol>\n
