A altera\u00e7\u00e3o dos pressupostos legais de atribui\u00e7\u00e3o ao unido de facto sobrevivo das presta\u00e7\u00f5es por morte do benefici\u00e1rio da seguran\u00e7a social unido de facto falecido n\u00e3o casado ou separado judicialmente de pessoas e bens, operada pela Lei nº 23\/2010, de 30\/08, enquadra-se na 2ª parte do nº 2 do artº 12º do C\u00f3d. Civil, aplicando-se imediatamente aos processos judiciais pendentes.<\/li>\n
  2. Tal aplica\u00e7\u00e3o, contudo, n\u00e3o determina a extin\u00e7\u00e3o da inst\u00e2ncia, por inutilidade superveniente da lide, nesses processos.\n
