  1. A prescri\u00e7\u00e3o \u00e9 uma causa extintiva das obriga\u00e7\u00f5es civis ou perfeitas e dela resulta para o seu benefici\u00e1rio (que a invoca com \u00eaxito) a faculdade de recusar o cumprimento da presta\u00e7\u00e3o ou de se opor, por qualquer modo, ao exerc\u00edcio do direito prescrito – artº 304º, nº 1, C.Civ..<\/li>\n
  2. A comunica\u00e7\u00e3o da seguradora, dirigida ao titular do direito, na qual, al\u00e9m de quantificar a indemniza\u00e7\u00e3o, se predisp\u00f5e a pag\u00e1-la, tem efic\u00e1cia interruptiva da prescri\u00e7\u00e3o, valendo como reconhecimento do direito do mesmo titular.<\/li>\n
  3. Tal mat\u00e9ria \u00e9 do conhecimento oficioso do tribunal porquanto, cumprindo ao juiz decidir se h\u00e1 prescri\u00e7\u00e3o, cumprir-lhe-\u00e1 tamb\u00e9m apreciar se esta foi interrompida.<\/li>\n
  4. O in\u00edcio do prazo de prescri\u00e7\u00e3o reporta-se n\u00e3o ao momento da les\u00e3o do direito do titular da indemniza\u00e7\u00e3o mas \u00e0quele em que o direito possa ser exercido.\n
