  1. O prazo (2 anos) da prescri\u00e7\u00e3o (presuntiva), previsto no art. 317º, c) do CC, inicia-se, em regra, com o momento da cessa\u00e7\u00e3o dos servi\u00e7os prestados pelo profissional liberal.<\/li>\n
  2. Cabe ao r\u00e9u o \u00f3nus de alega\u00e7\u00e3o dos factos constitutivos da excep\u00e7\u00e3o perempt\u00f3ria, designadamente do momento em que se inicia o prazo de prescri\u00e7\u00e3o.<\/li>\n
  3. Uma vez invocada pelo r\u00e9u (a quem aproveita) a excep\u00e7\u00e3o da prescri\u00e7\u00e3o (presuntiva), o tribunal pode servir-se de factos alegados pela parte contr\u00e1ria quanto ao in\u00edcio do prazo.<\/li>\n
  4. N\u00e3o \u00e9 leg\u00edtimo presumir-se judicialmente, sem mais elementos, que a \u00faltima data registada na nota de honor\u00e1rios e despesas corresponde ao momento da cessa\u00e7\u00e3o do mandato forense.\n
