    \u00c9 inconstitucional o n.º 4 do artigo 1817.º do C\u00f3digo Civil, por viola\u00e7\u00e3o do princ\u00edpio da igualdade e n\u00e3o medida em que restringe a sua aplica\u00e7\u00e3o \u00e0s situa\u00e7\u00f5es em que o investigante \u00e9 tratado como filho pelo pretenso pai, mesmo que esteja comprovada (ou quase comprovada) cientificamente.<\/div>\n<\/li>\n

    Por isso o investigante pode propor a ac\u00e7\u00e3o de investiga\u00e7\u00e3o de paternidade ap\u00f3s o falecimento do pretenso pai.<\/div>\n<\/li>\n<\/ol>\n
