  1. Esclarecida, num dos dois sentidos poss\u00edveis, pelo pr\u00f3prio declarante, a d\u00favida suscitada pelos declarat\u00e1rios, o tribunal n\u00e3o pode, posteriormente, interpretar a declara\u00e7\u00e3o optando pelo sentido oposto.<\/li>\n
  2. O preenchimento da previs\u00e3o da al. a) do nº1 do artº 216º do CIRE importa a alega\u00e7\u00e3o e demonstra\u00e7\u00e3o, pelo credor, de factos atinentes n\u00e3o apenas \u00e0 afecta\u00e7\u00e3o do seu cr\u00e9dito pelo plano de insolv\u00eancia, mas, outrossim, concernentes \u00e0 sua previs\u00edvel situa\u00e7\u00e3o\/afecta\u00e7\u00e3o decorrente da liquida\u00e7\u00e3o universal do patrim\u00f3nio do devedor segundo o modelo legal supletivo.<\/li>\n
  3. O plano de insolv\u00eancia pode afectar os cr\u00e9ditos da Seguran\u00e7a Social se tal for impetrado pelo insolvente\/contribuinte e como pressuposto para permitir a sua viabiliza\u00e7\u00e3o econ\u00f3mica – artº 190º nºs 1 e 2 al.a) dos Regimes Contributivos do Sistema Previdencial de Seguran\u00e7a Social, aprovado pela Lei n.º 110\/2009 de 16 de Setembro.\n
