  1.  A diminui\u00e7\u00e3o da garantia patrimonial do cr\u00e9dito, decorrente dos actos posteriores do devedor, que justifica a impugna\u00e7\u00e3o pauliana, ao abrigo do art.º 610 do C. Civil, deve ser aferida pelo confronto entre a situa\u00e7\u00e3o patrimonial daquele devedor no momento do acto impugnado e a que foi consequente a tal acto.<\/li>\n
  2. Tratando-se de fian\u00e7a, dada a natureza pessoal que caracteriza a garantia, tamb\u00e9m \u00e9 de considerar o valor do patrim\u00f3nio do fiador no momento do acto por ele praticado, objecto da impugna\u00e7\u00e3o, e n\u00e3o esse valor reportado \u00e0 data da constitui\u00e7\u00e3o da garantia.
