  1. O artº 204 nº 2 do C\u00f3digo dos Regimes Contributivos do Sistema Previdencial de Seguran\u00e7a Social aprovado pela Lei 110\/2009 de 16 de Setembro, n\u00e3o viola o artº 2 da Constitui\u00e7\u00e3o da Rep\u00fablica Portuguesa.<\/li>\n
  2. O artº 204 nº 2 da Lei 110\/2009 de 16\/09, enquanto norma especial, imp\u00f5e-se relativamente \u00e0 regra geral do art.º 749 do C.Civil.<\/li>\n
  3. Assim, o cr\u00e9dito da Seguran\u00e7a Social emergente das contribui\u00e7\u00f5es e respectivos juros de mora, que beneficia de privil\u00e9gio mobili\u00e1rio geral prevalece face ao cr\u00e9dito garantido por penhor, ainda que anteriormente constitu\u00eddo.\n
