  1. Nos termos da al\u00ednea b) do n.º2 do art. 21º do DL n.º 522\/85, de 31.12, na redac\u00e7\u00e3o conferida pelo DL n.º 130\/94, de 19.05, o Fundo de Garantia Autom\u00f3vel s\u00f3 garante, por acidente originado pelos ve\u00edculos referidos no n.º1 do mesmo artigo, as les\u00f5es materiais, quando o respons\u00e1vel, sendo conhecido, n\u00e3o beneficie de seguro v\u00e1lido e eficaz;<\/li>\n
  2. Assim, o Fundo de Garantia Autom\u00f3vel n\u00e3o \u00e9 obrigado a garantir a indemniza\u00e7\u00e3o ao lesado, se apenas foi identificado o ve\u00edculo que interveio no acidente e cujos danos causados a terceiros por esse ve\u00edculo n\u00e3o estavam cobertos por seguro, sendo desconhecidos o condutor e propriet\u00e1rio desse ve\u00edculo.
