    Os cr\u00e9ditos dos trabalhadores por sal\u00e1rios em atraso, garantidos por privil\u00e9gio imobili\u00e1rio geral (art\u00ba 12\u00ba da Lei n\u00ba 17\/86, de 14 de Junho), n\u00e3o preferem sobre o cr\u00e9dito garantido por hipoteca volunt\u00e1ria, em virtude de n\u00e3o ser aplic\u00e1vel \u00e0queles o regime estabelecido pelo art\u00ba 751\u00ba, mas antes o estabelecido no art\u00ba 749\u00ba, ambos do C\u00f3digo Civil.<\/div>\n<\/li>\n

    A norma do art\u00ba 12\u00ba da Lei n\u00ba 17\/86 \u00e9 inconstitucional quando interpretada no sentido de que o privil\u00e9gio imobili\u00e1rio geral nela conferido aos trabalhadores prefere \u00e0 hipoteca volunt\u00e1ria que garanta os cr\u00e9ditos dos bancos recorrentes.<\/div>\n<\/li>\n<\/ol>\n
