  1. Atenta a norma do artigo 23º nº 1 do C.Exp. segundo a qual devem ter-se «em considera\u00e7\u00e3o as circunst\u00e2ncias e condi\u00e7\u00f5es de facto existentes» \u00e0 data da publica\u00e7\u00e3o da DUP, estando o pr\u00e9dio j\u00e1 edificado e n\u00e3o se provando que havia uma muito pr\u00f3xima potencialidade de erigir uma outra edifica\u00e7\u00e3o, o que releva quanto ao \u00edndice de utiliza\u00e7\u00e3o \u00e9 o que se verificava no terreno \u00e0 data da publica\u00e7\u00e3o da DUP.<\/li>\n
  2. O art.26 nº1 do C.Exp. reporta-se aos terrenos livres de constru\u00e7\u00f5es, ou, existindo estas, estejam em ru\u00ednas ou n\u00e3o assumam autonomia econ\u00f3mica.\n
