  1. S\u00f3 o incumprimento definitivo confere o direito \u00e0 resolu\u00e7\u00e3o do contrato-promessa e \u00e0 restitui\u00e7\u00e3o do sinal em dobro.<\/li>\n
  2. Para se aferir da validade da resolu\u00e7\u00e3o apenas se pode ter em conta os fundamentos invocados pela parte que a ela recorreu, quando resolveu o neg\u00f3cio. N\u00e3o \u00e9 poss\u00edvel, para esse efeito, recorrer a (outros) fundamentos que, porventura, j\u00e1 existiam \u00e0 data, mas que n\u00e3o foram chamados para sustentar a declara\u00e7\u00e3o de resolu\u00e7\u00e3o.<\/li>\n
  3. Havendo um facto relevante para a decis\u00e3o da causa que est\u00e1 admitido por acordo das partes, e n\u00e3o figurando ele entre os factos provados, nos dos artigos 713.º n.º 2 e 659.º n.º 3 do CPC, o tribunal da Rela\u00e7\u00e3o pode adit\u00e1-lo a estes.\n
