  1.  Para efeitos do artº 814º, nº 1, al. g), do CPC, tendo em vista o exerc\u00edcio do direito de compensar atrav\u00e9s da oposi\u00e7\u00e3o \u00e0 execu\u00e7\u00e3o, a superveni\u00eancia da compensa\u00e7\u00e3o deve ser aferida pela “situa\u00e7\u00e3o de compensa\u00e7\u00e3o” e n\u00e3o pela “declara\u00e7\u00e3o de compensa\u00e7\u00e3o”.<\/li>\n
  2. Tornando-se os cr\u00e9ditos compens\u00e1veis ap\u00f3s o termo da fase de discuss\u00e3o e julgamento, designadamente porque o cr\u00e9dito principal s\u00f3 se constituiu com a senten\u00e7a na ac\u00e7\u00e3o declarativa, a compensa\u00e7\u00e3o com o contra-cr\u00e9dito, apesar deste ser anterior, n\u00e3o pode ser invocada no processo declarativo, sendo leg\u00edtima a sua apresenta\u00e7\u00e3o como fundamento de oposi\u00e7\u00e3o na execu\u00e7\u00e3o subsequente.\n
