O avalista de livran\u00e7a em branco apenas pode invocar a excep\u00e7\u00e3o material do seu preenchimento abusivo se alegar e provar que existiu pacto de preenchimento e que interveio na defini\u00e7\u00e3o do teor das suas clausulas naquela espec\u00edfica qualidade, pois que, s\u00f3 assim, ele se encontra no dom\u00ednio das rela\u00e7\u00f5es imediatas.<\/li>\n
  2. Transitada em julgado a decis\u00e3o que n\u00e3o leva \u00e0 BI factualidade alegada pelos AA no entendimento de que para prova da mesma \u00e9 exigido documento escrito, n\u00e3o podem eles, em sede recursiva, pugnar pela prova do facto, mesmo com base noutro documento que j\u00e1 estava junto aos autos.\n
