A) E H), DO RAU ; 428&ordm; A 431&ordm; DO C. CIV. . <br \/> <strong>Sum\u00e1rio: <\/strong><\/p>\n<ol>\n<li style=\"text-align: justify\">Tanto no plano doutrinal, como jurisprudencial, admite-se a aplica\u00e7\u00e3o do instituto da excep\u00e7\u00e3o do n\u00e3o cumprimento &ndash; regulado nos art&ordm;s 428&ordm; a 431&ordm; do C. Civ. &#8211; ao contrato de arrendamento, designadamente por parte do arrendat\u00e1rio face \u00e0 perda do direito do gozo da coisa locada imput\u00e1vel ao locador, ou mesmo devido a circunst\u00e2ncias fortuitas, independentemente da vontade do locador, justificada precisamente pelo car\u00e1cter sinalagm\u00e1tico do contrato .<\/li>\n<li style=\"text-align: justify\">Deste modo, se o locat\u00e1rio paga a renda e o locador n\u00e3o assume a presta\u00e7\u00e3o positiva de manuten\u00e7\u00e3o do gozo da coisa, pode aquele suspender o pagamento de toda a renda, tratando-se do n\u00e3o cumprimento que exclua totalmente o gozo da coisa, ou de parte da renda sendo a priva\u00e7\u00e3o parcial .<\/li>\n<li style=\"text-align: justify\">Sendo elementos essenciais do contrato a obriga\u00e7\u00e3o de proporcionar o gozo, a cargo do locador, e a de pagar a renda, por parte do locat\u00e1rio, ambas est\u00e3o ligadas por uma rela\u00e7\u00e3o de sinalagma, que n\u00e3o fica destru\u00eddo pela diversa natureza das presta\u00e7\u00f5es &ndash; continuada ou duradoura (do locador) e peri\u00f3dica ou repetida (do locat\u00e1rio) .<\/li>\n<li style=\"text-align: justify\">No \u00e2mbito das presta\u00e7\u00f5es que se destinam a assegurar o gozo do arrendat\u00e1rio, o RAU, nos art&ordm;s 11&ordm; a 18&ordm;, veio especificar o tipo de obras, distinguindo entre obras de beneficia\u00e7\u00e3o e de conserva\u00e7\u00e3o, e dentro destas as de conserva\u00e7\u00e3o ordin\u00e1ria e extraordin\u00e1ria .<\/li>\n<li style=\"text-align: justify\">Cumprindo ao senhorio a obriga\u00e7\u00e3o de assegurar ao locat\u00e1rio o gozo da coisa locada para o fim a que se destina, devendo efectuar todas as repara\u00e7\u00f5es ou outras despesas essenciais ou indispens\u00e1veis, se o n\u00e3o fizer, ap\u00f3s aviso do locat\u00e1rio, falta culposamente ao cumprimento da obriga\u00e7\u00e3o, sendo respons\u00e1vel pelos preju\u00edzos que cause ao credor, nos termos dos art&ordm;s 562&ordm; e segs. do C.
