  1. O c\u00e1lculo do valor da capita\u00e7\u00e3o dos rendimentos do agregado familiar do menor, para efeitos de interven\u00e7\u00e3o, ou n\u00e3o, do FGADM, \u00e9 presentemente aferido de acordo com as regras introduzidas pelo DL 70\/2010 de 16.06 – rectius seu artº 5º – as quais se aplicam aos processo pendentes \u00e0 data da sua entrada em vigor – artº Artº 3º do DL 164\/99 de 13.05 na sua atual reda\u00e7\u00e3o e artºs 1º, 2º, 4º, 5º e 25º do cit. DL 70\/2010.<\/li>\n
  2. O despoletamento da interven\u00e7\u00e3o do FGADM pressup\u00f5e, por via de regra, a realiza\u00e7\u00e3o infrut\u00edfera de todas as diligencias legalmente admiss\u00edveis e\/ou, razoavelmente poss\u00edveis, tendentes \u00e0 efetiva\u00e7\u00e3o da obriga\u00e7\u00e3o aliment\u00edcia dos progenitores do menor.
