  1. Na fixa\u00e7\u00e3o de alimentos devidos a menor \u00e9 de ter em conta, para efeitos do c\u00e1lculo dos rendimentos auferidos pelo agregado familiar em que se insere a menor, os auferidos pelo companheiro da m\u00e3e.<\/li>\n
  2. Para se chegar \u00e0 capita\u00e7\u00e3o prevista no artigo 3.º, n.º 2 do DL 164\/99, de 13\/05, o crit\u00e9rio a ter em conta \u00e9 o da capita\u00e7\u00e3o dos rendimentos do agregado familiar, tendo por refer\u00eancia o limiar m\u00ednimo do sal\u00e1rio m\u00ednimo nacional, independentemente das despesas efectuadas, as quais variam de agregado familiar, consoante uma gest\u00e3o mais ou menos prudente que de tais rendimentos fa\u00e7am.<\/li>\n
  3. O Fundo de Garantia de Alimentos Devidos a Menores, s\u00f3 interv\u00e9m a t\u00edtulo de natureza subsidi\u00e1ria e garant\u00edstica.\n
