    Tratando-se o facto danoso de um facto il\u00edcito que constitui crime, tendo sido com base nele que o autor assenta a obriga\u00e7\u00e3o de indemnizar, est\u00e1 o correspondente direito a indemniza\u00e7\u00e3o sujeito ao prazo de prescri\u00e7\u00e3o do artº 498º, nº 3, do CC.<\/div>\n<\/li>\n

    Sendo este o prazo aplic\u00e1vel, cabe ao lesado respeit\u00e1-lo, ainda que n\u00e3o tenha conhecimento da extens\u00e3o integral do dano.<\/div>\n<\/li>\n

    N\u00e3o havendo reconhecimento judicial e efectiva\u00e7\u00e3o do pedido de indemniza\u00e7\u00e3o nesse prazo, n\u00e3o pode o autor prevalecer-se do prazo ordin\u00e1rio de 20 anos quanto a novos danos sobrevindos ao mesmo per\u00edodo de tempo , pretendendo fazer iniciar nesse momento o prazo de prescri\u00e7\u00e3o supra referido .<\/div>\n<\/li>\n<\/ol>\n
