    As indemniza\u00e7\u00f5es decorrentes de acidentes que sejam simultaneamente de via\u00e7\u00e3o e de trabalho n\u00e3o s\u00e3o cumul\u00e1veis mas antes complementares, subsistindo, em princ\u00edpio, a emergente do acidente de trabalho para al\u00e9m da que for paga pelos danos causados pelo acidente de via\u00e7\u00e3o e se esta n\u00e3o reparar, por si s\u00f3, integralmente o dano. ~<\/div>\n<\/li>\n

    O nº 4 da Base XXXVII da Lei nº 2127 de 3\/8\/1965 condiciona o exerc\u00edcio do direito de regresso por parte da seguradora do acidente de trabalho contra os terceiros respons\u00e1veis pelo acidente ao n\u00e3o exerc\u00edcio pelo sinistrado do direito \u00e0 indemniza\u00e7\u00e3o no prazo de um ano a contar da data do acidente.<\/div>\n<\/li>\n<\/ol>\n
